2. What’s the point of this Privacy Statement?

This Privacy Statement tells you how we deal with your "personal data" (i.e. a technical term for information about any identified or identifiable living person). Please read on to find out what kinds of personal data we collect, how we use and protect it, who we share it with, how long we keep it for and how you can access and rectify it.


Please do not use our services or related services such as our website or app unless you are completely happy with this Privacy Statement.

4. What personal information do we collect and how do we use it?

For people who visit Bento’s websites or contact Bento for support

If you visit our website or contact us for support, we will use your personal information to provide you with a response to your question(s) or deliver the specific services you’re using. We collect and store the information which you give us via forms on our website or apps such as your company name, first name, last name, street address, email address and phone number ("contact data"), or when communicating with us by email or in some other way. We collect this information to contact you in order to provide you with our services or improve the services you are already using. We may also collect information about how you access our website such as the device you’re using, your IP address or network connection. We collect this information to improve our services and website e.g. by making it easier to navigate and make better use of the website.

For businesses using Bento’s services

If you’re a business using Bento’s services, such as Bento’s platform or AI technology services, we will collect your personal information to provide you with the use of our platform and related services.  We will collect personal information when you sign up or login to Bento and use our platform, or otherwise, as stated above, when you provide us with information.  

We will collect information you provide us with such as your business’s name, your name, the names of your staff, email addresses, phone numbers and the same for any other individuals associated with your business who may access, use or are otherwise involved in Bento’s services.  We collect this information to provide you with the use of our platform and related services such as creating and managing accounts. 

We work with partners to help us provide our services to you. We may sometimes therefore share your personal information with these partners to ensure you can continue to access our services and ensure we continue to provide you with the highest level of service.  

Depending on the service or platform you require us to provide, we may also collect and use personal information about your end user customers.  Such personal information will only be used in accordance with the data processing provisions set out in the relevant agreement which we enter into with you.  As set out in this agreement, we are the “processor” and you are the “controller”.  As the controller, you decide how the personal information of your customers will be used and you therefore need to ensure your customers understand how you collect and process their personal information, and how we will do the same.  This should be stated in your business’s privacy policy.  

For partners using or otherwise involved in the delivery of Bento’s services

We use partners to provide a related service such as integration services to our customers who use Bento’s services.  As a partner of Bento’s services, we may collect your company’s name, your full name, address, email address or telephone number.  We require this information in order to work with you so that you can provide us with your related services.  

Under the UK GDPR, we will use the lawful basis of "contractual", where we use contact data to fulfil obligations under an agreement with you. In other cases, we may have a legal obligation to process your personal data, such as in response to a court or regulator order. There may also be other “legitimate interests” to process your personal information such as preventing risk or fraud, providing and improving our products and services, providing reporting and analytics, testing out features or additional services.

5. How else do we use your personal data?

We use your personal data to operate, provide and improve Bento’s services. Our purposes for using such information include: 


5.1.1. Provide our services: we use contact data to provide our services and process transactions related to Bento’s services, including subscriptions, purchases and payments and refunds. 


5.1.2 Marketing: if you have given permission, we may, solely for marketing purposes, use your contact data to send you marketing emails, mails, calls or SMS with details of our services which may be of interest to you, including information about product announcements.


5.1.3 Usage, fraud and improvements: we may use your IP address and other customer behaviour data to recognise you when you visit, or return to our website or apps. This allows us to track anonymised traffic and usage patterns, prevent or detect fraud and help us improve our service. We may use cookies to do this. 6. How long do we retain personal data? 

6.1. We will only retain your personal information for as long as is reasonably necessary in the circumstances and delete or anonymise personal data as soon as the purpose of storage no longer applies and legal retention periods do not preclude deletion. To determine the appropriate retention period for personal data, we consider the following factors:


6.1.1. the amount, nature, and sensitivity of the personal data;


6.1.2. the potential risk of harm from unauthorised use or disclosure of your personal data;


6.1.3 the purposes for which we process your personal data; and


6.1.4. whether we can achieve those purposes through other means, and the applicable legal requirements.

7. How do we protect personal data?

7.1. Security is a high priority for us. We take appropriate precautions to protect personal data. We will make every effort to look after your data and treat it with the respect it deserves.


7.2. Your data may be transferred, stored and/or processed outside the European Economic Area (“EEA”) and United Kingdom (“UK”) as our suppliers sometimes operate from outside of the EEA or UK. We will only transfer your data outside of the EEA or UK in compliance with data protection laws and provided appropriate or suitable safeguards are in place to protect your data such as Standard Contractual Clauses or any other clauses, mechanisms or safeguards to ensure compliance. 8. To whom do we disclose personal data?

We may however disclose personal information to third parties if you consent and in the following circumstances:


8.1. Third-party service providers: we may allow access to your personal data by third parties or vendors who supply us with a service. Examples include IT service providers (to host, manage and service our data), website hosts, content delivery networks and businesses which assist us in undertaking communications, monitoring, testing or improving our website.

8.3. Transactions involving third parties: Third party suppliers may be involved in a transaction between us and you, and we may share information with these third parties in order to provide services, software and/or other content to you.


8.4. Protection of us and others: we may disclose personal data so far as reasonably necessary if we have reason to believe that it breaches our terms and conditions, or that such steps are necessary to protect us or others, or that a criminal act has been committed, or if there has been a complaint about content posted by you, or if we are required to do so by law or appropriate authority.


8.5. Business transaction: if Bento goes through a business transaction, such as a merger, acquisition by another company, or sale of all or a portion of its assets, your personal data may be among the assets transferred as part of this transaction. 


8.6. Consent:  We may disclose your personal information with your express consent.

8.7. Legal requirement: We may disclose your personal information if doing so is a requirement in order to comply with law enforcement requests, court orders or protect you or other’s rights, property or safety.

9. How to access and control your information?

9.1. You have the right to request a copy of your information, to rectify your information, to opt out from or restrict the processing of your information and any related communications and to request the deletion or anonymisation of your information. 9.6. Before completing a request, we may ask you to provide reasonable information to help us verify your identity. We should also point out that there are exceptions and limitations to each of the above listed rights.  Further, although any changes you make will be reflected in active user databases promptly or within a reasonable period of time, we may retain information for backups, archiving, prevention of fraud and abuse, analytics, satisfaction of legal obligations, or where we otherwise reasonably believe that we have a legitimate reason to do so.
